Terms of Service

1. Introduction
Welcome to Continuum, an API monitoring and observability platform operated by FlorisNexus ("Company", "we", "us", or "our"), an independent entity based in Belgium. By accessing or using our service at continuumnexus.com (the "Service"), you agree to be bound by these Terms of Service ("Terms").
If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
2. Description of Services
Continuum provides software-as-a-service (SaaS) solutions for HTTP API monitoring, including:
- Scheduled HTTP endpoint monitoring (GET, POST, PUT, DELETE)
- Multi-step request scenarios and workflow validation
- Real-time alerting via Email, Slack, and Webhooks
- Performance analytics and uptime reporting
We grant you a non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes, subject to these Terms.
3. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security and confidentiality of your login credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Payments & Billing
- Payment Processing: Our order process is conducted by our online reseller Lemon Squeezy, who acts as Merchant of Record for all orders.
- Taxes: All applicable taxes (VAT, sales tax) are calculated and collected by Lemon Squeezy as required by law.
- Subscriptions: Paid plans are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method on each billing date.
- Price Changes: We may change prices with 30 days notice. Continued use constitutes acceptance.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Monitor endpoints you do not own or have authorization to test
- Conduct denial-of-service attacks or stress testing against third parties
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Resell or redistribute the Service without authorization
6. Service Level Agreement
For paid plans, we commit to 99.9% uptime for the Service, measured monthly. If we fail to meet this target, you may be eligible for service credits as described in our SLA documentation.
7. Intellectual Property
The Service, including all software, documentation, and content, is owned by FlorisNexus and protected by intellectual property laws. You retain ownership of any data you submit to the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLORISNEXUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability shall not exceed the amounts paid by you in the twelve (12) months preceding the claim.
9. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Service ceases, and we may delete your data after a 30-day grace period.
10. Governing Law
These Terms are governed by the laws of Belgium. Any disputes shall be subject to the exclusive jurisdiction of the courts of Charleroi, Belgium.
